The Severe Consequences Of Domestic Violence

The fact that domestic violence causes physical injuries, dysfunctional families, and broken relationships is well known. However, unless you have been paying close attention to the legal developments related to this topic, you are probably unaware that there has been a radical change in the way our legal system deals with domestic violence.

Ever since our society’s attitude toward domestic violence began to change, numerous laws have been enacted every year that specifically address domestic violence within our state and our federal statutes. As a result, the consequences of committing or being accused of committing domestic violence are also growing. The following list illustrates some of the severe consequences associated with domestic violence cases:

1) Enhanced jail or prison time, fines, the completion of a fifty-two week batterer’s treatment class, and the issuance of a criminal protective order.

Our criminal justice system now deals with domestic violence as a unique offense. Domestic violence is no longer treated as a simple battery. Consequently, our system imposes enhanced and specialized sentences for these offenses.

2) The loss of employment opportunities.

One of the most serious consequences of domestic violence is the stigma that is attached to these crimes. With a conviction of domestic violence on one’s record, it can be very difficult to obtain employment in certain types of occupations, especially jobs within government.

3) The denial or revocation of a state license to engage in a particular type of business.

An allegation of having committed domestic violence can also make it difficult for a person to obtain or maintain a state issued license, such as a license to sell real estate or a license to work in or operate a care facility.

4) The issuance of a criminal and/or family law restraining order.

Restraining orders are issued by criminal and family courts routinely where there are allegations of domestic violence. An obvious consequence to these orders is the loss of liberty, to the extent the order forbids the restrained party from going to certain locations.

5) The loss of the right to possess firearms.

When a restraining order is issued, it is automatic that the offender shall be restrained from owning or possessing a firearm. This restriction is particularly burdensome to people with occupations that require the possession of handguns.

6) The loss of immigration status.

A conviction for domestic violence can result in the loss of a person’s immigration status. This loss of immigration status will occur, even if a person convinces the court to allow him or her to withdraw a plea of guilty upon successful completion of an anger management program.

7) An increase in the amount of spousal support paid.

The occurrence of domestic violence in a relationship is one of many factors the court must consider when ordering spousal support. Consequently, a perpetrator of domestic violence is more likely to be ordered to pay additional spousal support.

8) The loss of the right to collect spousal support.

In California, a person who is found to have committed domestic violence may lose his or her opportunity to collect spousal support.

9) The loss of child custody or visitation rights.

A major factor the court must consider in determining custody and visitation rights is whether or not there has been domestic violence within the relationship. Courts are particularly sensitive to this issue when considering the best interests of the minor children.

10) An automatic extension to a foreign spouse and his or her children to remain within the country and an increased obligation to support them.

In cases where foreign spouses make allegations of domestic violence against their spouses who are sponsoring them, the foreign spouse will be granted an automatic extension to his or her right to remain within our country. When this happens, the sponsored spouse’s obligation to support the foreign spouse and his or her children is also extended.

11) A civil lawsuit by the victim spouse.

Victims of domestic violence can file civil suit against their abusers. These lawsuits can result in awards of large compensatory and punitive damages.

12) An unequal division of property.

California law authorizes family law courts to award a spouse the other spouse’s interest in community property as payment for any damages awarded to the victim spouse pursuant to a civil lawsuit judgment.

13) A crime of moral turpitude.

Domestic violence is considered a crime of moral turpitude. Consequently, when a person has a conviction for domestic violence on his or her record, his or her credibility can be called into question when testifying.

As one can see, the price paid for committing domestic violence, or in some cases, merely being accused of it, can be quite severe. How these consequences can affect personal relationships has yet to be seen.

Do Pet Stain Removers Work Or Are You Being Taken To The Cleaners

Pet stains on carpet and other types of flooring can be nasty to get rid of and even nastier if you don’t. How do I know? I sell pet stain remover but I always tell people the truth about the products they are buying. Many web sites on the internet give a 100% money back guarantee on pet stain removers but how can they possibly guarantee a product when they haven’t even seen the mess that the product has to clean up. From my experience with amazing internet cleaning chemicals including pet stain removers is that they usually don’t work. Most pet stain remover websites bank on the fact that you either won’t take the time to return the product or you’ll give up on your pet stain problem and have a professional come in to finish the job. The truth about pet removal products is they sometimes work and they sometimes don’t it all depends on the surface that your cleaning up and how bad the damage really is. At least once a day I email a customer back and tell them they need a professional (in some cases a demolition crew) to come in and first take a look at the actual problem and then decide if they can accomplish the task.

There are two different types of pet stain removers, volatile chemicals (chemicals that react with certain compounds) and enzyme products. Chemical products work by changing the chemical make up of urine. This is all great except for the fact that you’re using a chemical on your flooring or carpet and chances are you’re not going to get all the chemical out. These chemicals can remain in the dye pores and fibers of your carpets for many years or until the carpet is replaced. Enzymes work by eating the urine on the floor and then turn anaerobic and die. It seems really gross but you can’t see it happening and enzymes are a part of nature unlike man made chemicals.

In my experience I have dealt with both types of concoctions and feel that enzymes do the best job. Enzymes smell better and won’t harm your carpets and are more environmental and people friendly. When using either of these methods there is one truth that holds true and this is where the sometimes they work and sometimes they don’t statement comes in. If the enzyme or chemical does not come in contact with the pet urine it will not work. If you’re pet stain problem is to the point that the wood or cement underneath the carpet has been saturated for an extended period of time it’s time to call a construction crew. Your sub floors will have to be replaced and cement has to be sealed, this is the only way to get rid of cat urine odors once this much damage has been done. For some of my customers that I talk to it just seems like having flooring removed or cement sealed is too hard to swallow and there just has to be an easier and cheaper way to solve the problem. The truth is that once cat urine as seeped into a porous substance like wood or cement nothing can remove or neutralize it. When it gets damp or humid that smell will always come back and in some cases get worse over time.

For infrequent pet stains or pet accidents pet stain removers can work extremely well. These products can easily neutralize and eliminate pet stains on a carpets surface or already sealed flooring. Don’t be fooled by amazing products and 100% guarantees because if they haven’t seen the problem the product is going to tackle they might be doing a good job at removing your money from your wallet and not the pet stain from your floor.

The Office (Season 1) DVD Review

One of the most refreshing new comedy series on TV, The Office catalogues the inner-workings of a fictional Pennsylvania paper company called Dunder-Mifflin. The name itself alludes to some sort of bureaucratic labyrinth administered by dunderheads, and in reality, it is. Unfortunately, what makes The Office so hilarious is the ability of viewers to relate to the onscreen office culture. The branch office of Dunder-Mifflin viewers are privy to is managed by the politically-incorrect, borderline lunatic Michael Scott (Steve Carell). Using twisted logic to set company policy, worn out clichés as a substitute for leadership, and an endless array of corny group activities to lift employee morale, he creates an office atmosphere that makes the career of Dilbert seem desirable in contrast.

Carell, star of the recent box office hit The 40-Year-Old Virgin, shines in the role of the nutty and eccentric office manager, and his talents are well complimented by Rainn Wilson who plays the part of Michael’s butt-kiss, rule-Nazi lackey, Dwight Schrute. Dwight’s over-the-top antics conflict with the rest of the office, particularly co-worker Jim Halpert (John Krasinski) whom Dwight would like to fire. A charming unspoken office crush between Jim and Pam Beesley (Jenna Fischer) makes for an interesting and recurring subplot. Both Jim and Pam epitomize the remainder of the cast of Dunder-Mifflin employees who come across as logical, well-reasoned, and normal individuals. Normal people stuck in a bizarre world where idiots like Michael and Dwight preside over their working hours. Similar in theme to the equally funny feature film Office Space, The Office provides us with a much more excitable Bill Lumbergh lording over an army of Peter Gibbons-like worker bees. For creators Ricky Gervais and Stephen Merchant, who first experienced success with the concept in the UK, it’s a recipe for pure, unadulterated laughter.

The Office (Season 1) DVD features six hilarious episodes including the season premiere in which a camera crew arrives at Dunder-Mifflin in order to film a documentary. Naturally, Michael tries to portray himself as a brilliant steward of office productivity, while office enemies Jim and Dwight engage in a series of desk battles. Viewers also get a glimpse of the regular flirtations between Jim and Pam. Other notable episodes include “Diversity Day” in which Michael engages in a feeble and half-hearted attempt to shed light on office diversity, while alienating most of his employees in the process, and “Health Care” in which Michael, afraid of bearing bad news, delegates his authority to Dwight who creates an utter fiasco of the company health care plan.

Rare Books At Auction

Rare and antique book collecting is a hobby that any person can easily learn, it is fascinating and can turn your hard earned pounds or dollars into hundreds (sometimes thousands) literally overnight. The skeptics out there will be thinking surely this is not the case. In a Pygmalion fashion let me tell you a true story:

I was with a work colleague who started talking about hobbies, he informed me of his passion for rare and antique books. During the discussion he told me how easy it was to spot first editions and that if you were fairly savvy you could actually make decent money from buying old books at charity shops, car boot sales, garage sales and jumble sales. Admittedly being an avid reader and wishing to earn extra money, putting the two together seemed like an ideal pastime. I was fascinated and wanted to know more, he took me to a local second hand bookstore, then on a web tour of the major book sites just to show the money being asked for some of the rarer first editions. I was taken aback by the difference in price from the second hand bookstores to the cheapest available on the web; I realized (as all collectors know) that a profit can be made relatively easily and quickly, given the right selling medium. So it would seem a protégé was in the making. Over the next few weeks I spent my time scouring the web and visiting charity shops in the local area. To my surprise and his, one of the first finds was a true first edition first impression by Mario Puzo for which I paid the princely sum of one pound (Yes £1.00) for. I listed the book on a niche auction site for rare and antique books and ten days later the book sold making a whopping seven hundred and fifty three pounds (Yes £753.00) profit. Needless to say I am now a convert to being a rare book auctioneer in my spare time.

Try it yourself, read the various articles out there on how to identify first edition books, go to your local charity shops and car boot sales and see what you can find. You never know what you will come across, or, how much you could sell it for.

Banks - Friend? or Foe

We all have bank accounts, and we all rely on banks to safekeep our money. We rely on them to extend different kinds of loan for our different needs. Therefore, we all have high regards on this institution whom we all considered as our friend.

Are they really? Lets find out…

What the bank disclose about your bank records

Most banks have certain policies on the disclosure of your personal information to private individuals. They all have rules regarding the information it will make available. They never divulge information unless there is a court order. But it is not the same when people from credit bureaus or genuine grantors of credit, inquire about your bank records.

Banks usually are very open in supplying information. Especially if you list the bank as your credit reference.

The following are the information the bank usually discloses:

1. Checking Account status - whether it is good or there have been overdrafts.

2. Loans - if you have existing loan with the bank. They even give the information on how long the loan is and if you are making the payment on time. Also the type of loan you have with the bank, mortage, personal loan or auto loan.

3. The size of your savings account - they don’t usually give the the exact amount but they give the idea how much by providing the number of figures of your deposit.

Banks give credit institutions updated information about your available credit and the manner you are paying your loan. These are at times the basis of credit card companies in giving your maximum allowable credit lines.

A good number of merchants inquire from the bank if the check you are presenting is good. They also inquire if the credit card you are presenting can cover the amount you are purchasing. They don’t give the exact amount but they will tell if the merchant can go ahead with the transaction.

Now, the question is, can we prevent a bank from giving out this information?

The answer is No.

It is virtually impossible to stop them from giving away the information on your bank accounts. Unless, you are doing business with a very small bank and they know you well. You can always request them to withold any information on your bank accounts. This is especially true if the bank is not automated.

The only setback of this is, if you wanted your credit grantors to get the necessary information on your bank accounts to be able to obtain additional credit more easily.

Banks Play Tricks with Interest

Loan officers play tricks for banks to earn an additional 1/4% or even 1/2% from borrowers. Here are some of the tricks to watch out.

1. Loan officers prefer to do the negotiation at the bank. Since it is a familiar territory, they have the advantage over the borrower.

2. They don’t mention the interest rate at all. They just fill it in on a note.

3. They will give you an x% since you badly need the money today. Promising to discuss it later for a much lower rate. He hopes that you’ll never going to bring it up again. Certainly he won’t.

4. They will talk as if the rate for a certain type of loan is final and no longer negotiable when in fact there is always room for negotiation.

5. They intentionally postpone the rate discussion for as long as possible, hoping the borrower will weaken under deadline pressure.

6. Emphasizing on how little the interest cost after taxes, comparing it with finance company rates, secondary mortgage rates or the cost of equity capital.

To counter some of these tricks, you may want to try these.

1. The first question you should ask to the loan officer is the interest rate so you will have this information as your basis for future negotiation.

2. Do the negotiation in your office not at the bank. This will give you a familiar ground.

3. Negotiate everything as a package including the rate, repayment schedule, collateral, compensating balances. Remember, bankers strategy will be to try to nail down everything else and then negotiate interest rate when the borrower has no more leverage and no room to maneuver.

What Banks Don’t Tell You

1. Some banks say they let you draw on all checks immediately, provided you put up another bank account as collateral. Truth is, if a check backed by a six-month certificate bounces, the bank can break into the certificate before maturity. If it happens you will have to pay an interest penalty.

2. Banks like to publish their effective annual yield, whereas money-market funds are legally permitted to advertise only the simple interest rates. The long standing rule inadvertently conceals the fact that money-market funds do compound interest on a daily basis. If a bank and a money-market fund pay the same rate, the bank will appear to offer more by advertising the effective rate.

How Safe is Your Bank

When banks run into financial problems, they behave like any other troubled company. They sometimes try to hide problems and limp along the best they can. Here are some signs to watch out.

1. There’s a high turnover among the officers.
2. Paperwork and record-keeping become sloppy.
3. The bank encourages customers to extend credit when officers know it really isn’t necessary.

Uganda Travel: The Pearl Of Africa Reborn

Uganda is a land of breathtaking contrast. Right from the border with Kenya in the east to that with the giant Democratic Republic of Congo (DRC) in the west, the landscape and vegetation can be described as a kaleidoscope of tantalizing beauty. Winston Churchill, one of the United Kingdom’s great historical figures, summed Uganda in four words: ‘The Pearl of Africa’.

Though it is often easy to look over the country’s shoulder to its not too glamorous past, one thing that Uganda’s hospitality industry has learnt from its troubled history is flexibility. Holidaying in Uganda can be a memorable affair for all categories of regional tourists, be they budget, economy or high spending tourists.

Deciding on a holiday destination

A first time traveler to Uganda is most certainly spoilt for choice, particularly if the tourist is from Kenya. Uganda can be accessed through air (Entebbe International Airport), road via Malaba or Busia border entry points or even through Lake Victoria although it’s mostly regular business people who prefer this route. Entry and exit formalities for East African nationals have been simplified. The decision on holidaying in Uganda is usually motivated by a number of factors prominent among them flexibility of budget, refreshing experience and the warmth of the people.

Uganda excels in all the listed factors. The hospitality industry has evolved rapidly over the last decade, catering for all classes of visitors while offering nothing short of value for money. The Uganda experience is truly refreshing, be it in bird-watching, nature walks or cultural tourism. The communities are welcoming, with both urban and rural folks radiating warmth, although just as in any society there are bound to be some green flies in the visitor’s ointment.

Special Interest Tourism

Uganda has a well-established special interest tourism structure that has attracted tourists from not only Western Europe but also Africa and Asia. The special interest tourism areas are nature walks, gorilla trekking, bird-watching, mountain biking, sport fishing and white water rafting.

Eco-tourism has come of age internationally, for guests who prefer nature ‘as it was’ without the distortions of social economic transformation. Uganda offers new nature trails in virtually all protected areas. Tourists can walk with guides to view at close range some of the many endangered species for which the country is famous. These include the mountain gorillas, chimpanzees, the red and white colobus and blue tailed monkeys. The country is filled with birds, butterflies and rare plants that one can sample during nature walks.

Bird-watching

The Uganda Wildlife Authority has put in place new bird sanctuaries at strategic sites, including Lake George and Edward. A new survey on Uganda wildlife indicates that there are at least 335 species of birds and more than 144 species of butterflies at Kabale Forest National Park. Among the rare birds are the red-winged francolin, red-chested fluiftail, white-napped pigeon, African pitta, joyful greenbul, grey-winged robin, Abyssinian ground thrush, grey-crested flycatcher and the masked and the black-capped apalises. The Budongo Forest is one of the places where a thriving community eco-tourism takes place.

Mountain biking

Several areas are a haven for mountain bikers. These include Rukungiri, and Kabale districts in the west, Mbale and Kapchorwa districts in the east, local mountain bike trails are mapped out to assist tourists, but they have to bring their own bikes.

Sport fishing and white water rafting

Uganda offers a great opportunity for sports anglers. The ferocious tiger fish is common in Lake Albert, in the west Nile region, while catfish and tilapia abound in the all waters of Uganda. However, the most popular fish is the Nile perch with a record catch of over 100 kilogrammes. The fish species is abundant in Lake Victoria and River Nile. Through efforts of tour and travel firms, white water rafting has become a popular sport, with more than 500 tourists participating every month.

Camp safari

It is prudent to choose a camp safari if you decide to visit some of Uganda’s exotic special interest tourism areas. This will enable you to fully enjoy the flora and fauna of the country. Uganda’s waters teem with fish while over 200 bird species thrive in national parks and protected areas. Uganda’s ‘Pearl of Africa’ tag is best appreciated by visiting some of the country’s tourist site.

Therefore, it is possible to have a fair idea of how a potential pet will react to different situations on the basis of the breed chosen. A true dog lover will make a special effort to take into consideration all factors to ensure that the breed selected as their pet adapts well to their needs.

Anyone for a Dalmatian?

The first thing to bear in mind is that the type of dog chosen must fit in with your current - or projected - lifestyle. The Dalmatian can serve as a good example. This breed is well known for producing cute little puppies, but what many dog owners don’t realize is that they’re going to need a great deal of exercise and playing even well into their mature years. So, if you choose this breed, you have to be aware that your dog is going to need the attention and love of a master, or mistress, that has the time for it. It’s going to need plenty of physical exercise and mental stimulation to be a truly healthy and happy pet. As you can imagine, this is no easy task.

Considerations

Before you decide on a breed of dog, consider the following questions, as a minimum:

· How much time can I, or my family, spend with the dog or puppy?

· How often will the dog be left alone, and for how long?

· How big is the yard or exercise space?

· Is it fenced?

· Do I want the dog to be inside the house or outside? For how long?

· How much time do I have to walk or exercise the dog?

· Do I want a dog that is playful and friendly with everyone or one that is a good watchdog?

· How often am I prepared to groom and maintain the dog’s coat?

· How much time can I spare to work with the dog for training and obedience?

· Will there be any small children around the dog?

· Are their other pets in the family?

· How much money am I prepared to spend on getting - and maintaining - the dog or puppy?

Once you’ve answered these questions, and any more that may be relevant to your particular situation, you can then start looking at the different dog breeds and their characteristics, in the knowledge that your choice will be based on sound reasoning.

Make sure you get it right

If you’re planning to get a new dog or puppy, the breed chosen definitely does matter, both for you and for your future pet. If you spend the time and effort to ensure a good match, you can be much more confident that both you and your pet will be happy - make sure your dog can fit easily into your lifestyle, so that you can give it, in return, the lifestyle it deserves and needs.

Successful Breastfeeding - Prepare Yourself!

“I’m going to breastfeed”, is a common refrain amongst pregnant women. But what many women don’t do is to prepare for breastfeeding beforehand. They simply make the statement and then put it to the back of their minds. The next time the issue arises is often in the delivery suite when the new mum has just gone through the ordeal of childbirth.

When presented with her newborn, the new mum may be exhausted and the last thing she wants is to have anyone else poking at her. The result? All her good intentions to breastfeed become overshadowed when a bottle is produced and the exhausted mum is told that she can try to give a breastfeed later on in the day!

To stand the best chance of successfully breastfeeding, pregnant women need to prepare during their pregnancy.

Successful breastfeeding results from careful planning. And the most important way to successfully breastfeed is to give the newborn baby a breastfeed within half an hour of her birth! Not later on!

Being committed to breastfeeding, but not placing too much pressure on oneself, can work wonders! If a new mum pressurises herself she is likely to end up feeling stressed and, as a result, will be more like to give up breastfeeding early. Having a new baby is stressful enough! By preparing to breastfeed whilst you are still pregnant, you will feel more relaxed about it when the baby is born.

The following will certainly aid you in your breastfeeding experience:

Join a Breastfeeding Support Group to chat to new and experienced breastfeeding mums. Ask questions about breastfeeding and enquire if you can watch some babies being offered the breast.

Observe how each baby is put on the breast.

Look at how different mums hold their babies. Getting the right position is essential to avoid early problems.

Also ask for advice about breastfeeding friendly shops and changing facilities!

Read books, magazines or online articles, to find out as much as you can about breastfeeding successfully.

Get measured for a nursing bra when you are around 38 weeks pregnant. Many baby stores now offer this service. Try a few different styles to find one that is comfortable. Also purchase a couple of night-time nursing bras.

Nursing pads are essential for absorbing leaks and avoiding embarrassing stains!

Nursing shells can be very useful on nights out, as they will catch leaks. Or you can use them during breastfeeding to collect milk from the breast not being used, storing the milk for later use.

Nipple Creams can help soothe sore nipples.

Front-opening or Nursing Nightdresses or Pyjamas can make it easier to breastfeed at night.

Loose- fitting tops can be comfortable during the day. Try layering so that your back is not exposed when you are feeding. Or use a poncho or wrap if you feel anxious about breastfeeding in front of other people.

A Breast-pump is a fantastic investment as it can be used to collect milk for bottle feeds, making up first solids or when you are away from the baby to prevent engorgement or ease mastitis. Ask other mums to recommend one they liked.

A V-shaped Cushion can make breastfeeding more comfortable as it offers good support for mums back. Or a Nursing Pillow can be used to raise the baby up to a more comfortable height for mum.

A Steriliser is a compact way to keep baby utensils and breast-pump attachments clean and sterile.

Some mums find a Gliding chair very useful, particularly for night feeds.

If you are well prepared for breastfeeding there is no reason why you should not succeed.

Health Benefit of Green Tea: Cancer Prevention

There have already been numerous studies that prove that green tea helps protect drinkers against cancer. Statistics show that cancer rates are lower in countries where people regularly drink green tea. Research has shown that polyphenols are one source of the health benefit of green tea. Researchers believe that these substances found in green tea are influential in preventing the development of cancer.

Studies involving animal tests have shown that green tea reduces the formation of tumors for cancers of the skin, esophagus, bladder, pancreas, ovary cancer and prostate. The antioxidant activity in green tea has been reported to produce such results. Researchers are also of the belief that polyphenols are essential in destroying cancerous cells and stopping their progression.

Skin Cancer

Scientific research suggests that the main polyphenol in green tea, which is called epigallocatechin gallate (EGCG), and other green tea polyphenols possess anti-inflammatory and anti-cancer properties. One study has been done on the health benefit of green tea on the skin. The study showed that drinking tea helps prevent the onset and growth of skin tumors.

Esophageal Cancer

Animal studies have also been conducted and they showed that green tea polyphenols help stop the growth of esophageal cancer cells. However, studies done on people have various results regarding the health benefit of green tea. One study showed that green tea consumption is an effective way to be protected from esophageal cancer, specifically among women. But another study showed that drinking green tea increased the risk of developing esophageal cancer. This shows that before green tea can be recommended for esophageal cancer prevention, more research has to be done.

Bladder Cancer

A few studies have been conducted on the health benefit of green tea on the human bladder. Research has been done to determine if there’s a connection between bladder cancer and consumption of green tea. One study revealed that women who drank green tea reduced their probability of developing bladder cancer. The study was followed with another one revealing that patients with bladder cancer, specifically men, who consumed green tea had a significantly improved chance of surviving compared to those who did not drink tea.

Pancreatic Cancer

Research has also been done on the health benefit of green tea on the pancreas. A study found that men and women who drank green tea had lesser chances of developing cancer in the pancreas. However, the study didn’t particularly point out that green tea was exclusively responsible for reducing the risk of pancreatic cancer. Researchers still need further studies before they can start recommending green tea for pancreatic cancer prevention.

Ovarian Cancer

In China, a study was conducted on patients with ovarian cancer. It was observed that women who drank a cup of green tea a day were able to survive longer and lived the longest compared to women who did not drink tea at all.

Prostate Cancer

Green tea extracts have been shown in laboratory studies to prevent the development of prostate cancer cells in test tubes. A large study showed that people who drank green tea with increasing frequency, quantity and duration reduced their risk of developing prostate cancer.
