If you loaned a friend $20, would you rather get the money back today or a year from now? You should want the cash today. Think back to the price of movie tickets 10 years ago. The price for a movie ticket at one point was just a few dollars and has risen to almost $10 due to the factor of inflation. By receiving cash today, rather than the future, you can invest the money into an alternate source and potentially receive a higher return for your money. Future value includes the amount of money you would earn through growth in your investments in the future assuming a given interest rate. It is what the cash is worth at a particular time in the future, while present value refers to the value of a given sum of money today. The same principle applies to real estate notes. A real estate note, a mortgage for example, is created with specific terms, conditions and a length of time for its return. In order to exchange the note for cash, a note’s present value is determined through a discount analysis to appraise its current worth, which will differ from the note’s value in 10 years.

To demonstrate TVM and why it can be more advantageous to have money now rather than the future, consider the following example. If you own a real estate note that is appraised at present value for $150,000 you can cash out now and spend the money, or you can invest in alternate sources for a higher return on your investment. By receiving the money today, you can avoid dealing with late payments and the risk of not receiving a payment at all. Immediate cash appeals to most much more than receiving money in the future. The following illustration of TVM shows the change in value of $150,000 over a year if invested with a rate of return of 10 percent.

Future Value = (Present Value) x (1 + Rate of Return)

Future Value = (150,000) x (1 + 10%)

Future Value = (150,000) x (1.1)

Future Value = $165,000

Directed by James Mangold, the talent behind such notable films as Kate & Leopold (2001) and Identity (2003), Walk The Line begins in the rough and tumble world of Depression-Era Arkansas where a young Johnny Cash (Joaquin Phoenix) tends to the family cotton farm with his parents and older brother. Early on, a family tragedy strains the relationship between Cash and his father, providing a glimpse into the epic moment that would shape his life forever. Soon after, the film jumps to the early 1950s where Cash perfects his guitar talents while stationed overseas in the Air Force. His marriage to high school classmate Vivian Liberto lands the two in Memphis where Johnny supports the family as an appliance salesman while pursuing his musical interests on the side. Here, Cash founds The Tennessee Two with bassist Marshall Grant (Larry Bagby) and guitarist Luther Perkins (Dan John Miller), and the trio plays its way to a music deal with local label Sun Records.

As part of a promotional campaign, Cash is put on tour with other “rockabilly” newcomers Elvis Presley (Tyler Hilton), Jerry Lee Lewis (Waylon Payne), and Carl Perkins (Johnny Holiday). But during his tour with the quartet, the life of Johnny Cash takes numerous turns. He meets the affable June Carter (Reese Witherspoon), begins an addiction to amphetamines and alcohol, and watches his marriage to Vivian deteriorate under the strain of his constant absence. All three would come to define the next fifteen years of Cash’s life as he struggled to triumph over his personal demons. Despite his all-encompassing drug addiction, Cash nevertheless manages to crank out hits, but his personal life hits rock bottom following bouts with divorce, loneliness, depression, and his continued drug addiction. When Cash reunites with June Carter in a musical collaboration, the magical bond between the two is amplified. But Johnny’s addiction threatens to ruin everything they’ve built together.

The most impressive aspect of Walk The Line, aside from the storyline itself, is the performance of Witherspoon and her counterpart Phoenix. Amazingly, both provide their own voiceovers, and for the casual listener, very little difference can be detected between the Hollywood talents and the real life country music legends they impersonate. Much was made of the performance of Joaquin Phoenix in the days leading up to the film’s release, but I came away more impressed by Witherspoon. Apparently, so did the Academy because they awarded her their highest honor for the role. What stood out the most was the actress’s down-to-earth smile and charismatic mannerisms. She created a character with ample assertiveness, yet one that burst at the seams with an infectious optimism and love for life. As such, the audience can’t help but fall in love with June Carter. In addition, Witherspoon displays an amazing singing voice that accurately captures the distinct and unique aspects of June Carter’s talent. Overall, Walk The Line is a fine film, and a fitting remembrance to the career and life of country music’s greatest icon, Johnny Cash.

I have discovered how awesome eBay™ really is!

It was not too long ago that I had no clue what eBay™ was about, and now look at me, an eBay™ enlightened Mom!

Would you like to get there too? It is not difficult and it is really a lot of fun.

eBay™ is the latest, and greatest money-making endeavor I have found. And believe me, I have searched high and low in all kinds of markets and businesses to find something that could work for me.

Nothing I found seemed to tickle my fancy until eBay™. There were always too many loopholes to stop me from pursuing any of the ideas I came across. Such problems I found were, for example: the costs which seemed to escalate, the amount of time that was required was more than I could give, the steps were way too complicated and the end result always seemed way too small.

No, not me boy, I wanted to invest only a small amount of money, I wanted to spend about 15 hours on this per week, and I needed it to be pretty simple, something that if I stopped at any moment, (you know the kids always distract me at the wrong times) I needed to be able to pick up where I left off and not end up completely confused. Okay, now you have browsed around eBay™, you have familiarized yourself with auctions, and you have purchased something! That is great and you are now ready to make some money.

Step 3 - Sell something from your attic.

Don’t panic if you do not have an attic. Do you have a cupboard, a closet, a drawer, a child! No, just kidding, there is no need to sell your firstborn, at least not yet! But you do need to find something to sell, and it would be best if it was not your mother’s $5,000.00 wedding ring please!

You do not want to start with an expensive item, remember this is a first sale for you so make it easy for yourself. Also, keep in mind shipping costs and packaging needs, so size and weight is a factor here.

Once you have found your first item, or items, take some really good pictures of them and upload the photos on your computer. You are now ready to set up a seller’s account on eBay™. My other articles can guide you through this process.

Fast forward to this summer. The restaurant revamped their backyard, including the tree house. The railing now consists of uniform boards about three inches apart. The house is reached not by a ladder and trapdoor, but via a bona fide staircase. The screen door is gone, the windows are covered in glass, and several of the tree’s branches have been pruned back to discourage climbing. But the worst part, according to my 10-year-old, is that the rope swing has disappeared. Matthew declared the whole structure boring. In today’s world, kids have far less freedom than in previous generations. Their lives are more controlled-sometimes because of parents’ fears of an increasingly dangerous society, but often because we’ve somehow come to believe that to grow into successful adults, children’s activities must be channeled, scheduled and programmed from infancy.

Danger comes in many forms, from a stranger encountered on the way to school (who may be a neighbor out walking his dog, but you never know), to free time not filled with enriching activities. But, in my opinion, kids need a little danger in their lives. They need to test their boundaries, to learn how to climb a ladder and squeeze through a trapdoor. They need to hurl themselves into a pile of hay and learn it’s best not to land on your face. If grown-ups clean up their world too much, kids will never learn how to push themselves. They’ll never have the satisfaction of trying things that are a little scary, a little off their parents’ radar, and accomplishing something that belongs just to them.

One of the few places kids can still push their limits is with books. It’s possible to step outside your safe life with a story, or try new ideas on for size. But many adults want to clean up their kids’ reading choices as well. I know parents who abhor Barbara Park’s perennially popular Junie B. Jones chapter books because the spirited Junie isn’t a good role model, or won’t read Winnie the Pooh because Christopher Robin can’t spell very well. I also know a lot of authors who are afraid to write books that are slightly subversive because they worry editors won’t publish them. But for every parent who insists on only safe reading for their child (and it’s every parent’s right to do so), there are at least two parents who believe it’s okay for kids to wade into the danger zone through fiction. I’m not advocating murder mysteries for preschoolers here, just books that might be considered slightly uncivilized, or more entertaining than educational. Let’s look at some popular examples:

When I first saw Walter, the Farting Dog by William Kozwinkle and Glenn Murray, illustrated by Audrey Colman (a picture book whose plot needs no explanation), I was worried that children’s publishing might be sinking a little too low. But as it started winning awards and spawning sequels, I changed my opinion. Let’s face it: farting makes kids laugh. And if your child finds this book hysterical, you should be glad. In order to get the joke, kids need to know that noisy bodily functions are considered impolite. Laughing about them is one of the perks of childhood. Don’t worry, they’ll outgrow it.

A picture book coming out this December that’s already creating a buzz is 17 Things I’m Not Allowed to Do Anymore by Jenny Offill, illustrated by Nancy Carpenter. The heroine utters such statements as I had an idea to staple my brother’s hair to his pillow. I am not allowed to use the stapler anymore. She also glues her brother’s bunny slippers to the floor, and shows Joey Whipple her underpants. Both big No’s. This ingenious story should satisfy two camps of parents; those who want kids to see consequences for inappropriate behavior, and those who don’t mind letting their kids live vicariously through a curious, mischievous character. A pop-up book due out later this month from three publishing powerhouses-Maurice Sendak, Arthur Yorinks and Matthew Reinhart-lets young children face the monsters hiding in their closets and come out on top. In Mommy?, a young boy wanders into a haunted house looking for his mother and encounters creatures like a goblin, a mummy, and Frankenstein. Instead of running scared, the boy pulls pranks on each monster, deflating their power and showing how humor conquers fear every time.

Speaking of scary, if you haven’t read any of the enormously popular Series of Unfortunate Events middle grade novels by Lemony Snicket, do so. With titles like The Bad Beginning, The Miserable Mill, and The Penultimate Peril, and cautions from the author such as, “If you are interested in stories with happy endings, you would be better off reading some other book,” these are clearly stories where adults dare not tread. But children brave enough to venture between the covers will find hilarious plots full of nail-biting twists. The intelligent Baudelaire orphans have unusual skills (Violet for inventing, Klaus for reading and researching, and baby Sunny for biting) that make them admirable heroes.

Lauren Myracle enters the private world of teen girl talk in her young adult novels TTYL and TTFN. The titles alone might raise some parents’ suspicions because unless they’re well-versed at IM (instant messaging), they won’t know what the abbreviations stand for. In fact, the entire novels consist of conversations between three high school girls written in emails, text-messaging and IM’s, using the standard computer shorthand that includes abbreviated spelling and quirky syntax. If you’re not an IMer yourself, you’ll find the books somewhat difficult to read. But you and I aren’t the target audience here. And though the format might keep adults from examining the books too closely, the plots are standard upper young adult fare-relationships, family trauma, peer pressure, even drugs and alcohol-handled in a believable manner that conveys growth of character by the end of each story.

As an author, if you’re inspired to delve into the slightly dangerous, dark or subversive corners of childhood with your books, feel free to do so. Don’t limit yourself to all that’s bright, safe and up to code. Allow kids places where they can wander away from their parents’ watchful eyes and have an adventure. If the adventure’s in a book, they’ll always come home safe and sound. And if you’re still not convinced, consider this: In the backyard of the restaurant, the tree house now sits empty. But the books I’ve described above are flying off the shelves.

When Terminal Server is installed and enabled on a Windows Server, users can connect to virtual desktops, or single instances of an application. User’s applications, or virtual desktops, are executed on the server instead of the client. The end user sees their terminal services session across the network or internet connection, similar to VNC or Citrix.

Unlike these other remote control programs, a Windows Terminal Server runs a in a multi user mode that allows multiple users to log into the server at the same time. Depending on the hardware and resources that the server can provide, a single Terminal Server can support dozens or even hundreds of simultaneous users.

Terminal Server sessions provide support for many client side resources. For example, a Windows 2003 Terminal Server supports accessing your local disk drives, printers, serial ports, sound and the windows clipboard while connected to a Terminal Services session.

The Windows XP Pro operating system also provides similar functionality. It is called Remote Desktop . The main difference is that it only supports one user at a time. If you connect to a Windows XP Pro machine via a Terminal Services session, it will actually lock the console of the physical machine. Remote Desktop can be enabled on an XP Pro machine by accessing the System applet, selecting the Remote tab and checking the option that says Enable Remote Desktop on this computer .

Building a stable Terminal Server solution can be a lot of work, and this article merely scratches the surface of the technology, but hopefully you now have a better idea of what it is and what it can do.

Still, these lawyers can provide effective representation for their clients. The reason is that most opposing attorneys are of the same mindset. This mindset is; I am a family law attorney and if my client needs tax advice they should seek the advice of a tax professional. This is good advice, but seldom clients actually abide by it.

The tax consequences of a divorce can have a tremendous impact on the actual (as opposed to stated) value each side receives in a property division or support order. This leaves those lawyers with an understanding of tax law in a superior bargaining position. The following article will discuss a couple areas where family law and tax law intersect.

Support Orders

The bargaining chips here are the exemptions and filing status. Exemptions are a tax deduction so they are a benefit for the spouse receiving them. Two ground rules to keep in mind is that a custody split should never be 50/50, (because neither party will get the exemption) and the court can’t order parties to take a particular filing status.

The advantages of taking certain tax positions can be analyzed by the DissoMaster software. Once the exact benefits to both sides are calculated, the negotiating begins. Generally, the tax deductions should be negotiated towards allocating them to the higher earning spouse. In that way both spouses collectively pay fewer taxes. Another result is that the higher wage earning spouse has a higher net income which will result in a larger order of support to the receiving spouse. All of this is, of course, is negotiable and can even be conditioned on certain events. For example, an agreement might have a provision that Wife sign the IRS form allocating the exemption to husband by January 15th each year, provided that she receive increased spousal support of a certain amount. These tax aspects can have a major impact on a client’s future finances and should be a point of negotiation.

Property Division

This is an area where a basic understanding of tax law is crucial to obtaining a fair result for the client. Family law courts have two fundamental rules here:

1)The court does not take tax consequences into account when determining value

a.Example: If you are awarded the family residence and plan on selling it after the divorce, the court will not reduce the value it puts on the house just because you will have to pay taxes on the gain from the residence

2)Pursuant to IRC 1041, property transfers subject to a divorce are not taxed

a.Example: If you sell your interest in the family home to your spouse, you will not be taxed

California community property law states that each spouse shall get an equal share of the community property. This can be more complex than it seems. As an example, let’s say that we are awarding stock to Wife with a fair market value of $200,000 and we are awarding husband cash from the community bank account equaling $200,000. While this might seem equal, it probably is not. The stocks are subject to taxes, either a loss or a gain. If Wife has to pay taxes on $100,000 of the stocks when she sells them, she has gotten the short end of the stick.

Calculating Loss or Gain

The loss or gain for tax purposes on any property is equal to the selling price minus the basis. Basis is the purchase price of the asset, plus improvements, plus fix up costs, minus depreciation and deferrals. Obviously it can get complicated trying to figure out all these factors, so attorneys need their clients to take an active role in providing this information.

The situation gets even more complex when dealing with pensions. Pensions have early withdrawal penalties and other serious tax implications for divisions.

Also, a loss or gain may be avoided entirely with some estate planning. For example; if the spouse was awarded the residence and lived in the residence until his or her death, then the basis for whomever he or she willed it to, would be the fair market value at the time of the transfer.

Solutions

How can you split everything equally when you are comparing apples and oranges? One way would be to take the King Solomon approach and divide everything in half, giving each side half an orange and half an apple. Sell the house and divide the proceeds. Each spouse takes half the stocks. If the pension or IRAs are unequal, roll some over from wife’s IRA to husband’s IRA or vice versa to make them of equal value.

However, the best course of action for clients is to hire an attorney that has a basic understanding of the tax implications of divorce. Clients can test prospective attorneys in this regard with a few preliminary questions during the initial consultation. An attorney with this basic understanding can save clients lots of headaches down the road.

These ADR’s can be then represent shares in that foreign market. There are many advantages to using ADR’s that we have talked about in class such as the liquidity of these assets. Since the whole process of investing in foreign markets has become easier, the market has become far more liquid. The annual dollar volume of ADR’s has increased from $75 billion dollars in 1990 to $550 billion in 2002. Instead of having to different brokers and red tape to sell foreign investment we can simply trade ADR’s.

As technology advances it has become easier to invest in foreign companies and we can see this through the use of depositary receipts. Not only are depositary receipts issued in America but they are also issued in other countries as well such as Euro DR’s, Singapore DR’s and China DR’s. In the Wall Street Journal on 2/24/06 there is an article, “Bank of Communications Seeks Listing” where we can see that Hong Kong-listed Bank of Communications Co. has gained approval to offer shares on China’s stock exchange and are willing to offer China depositary receipts (CDR’s). By issuing CDR’s, the bank is better able to sell shares to foreign investors.

Not many supplies are needed for this job and there is a good chance you have everything on this list except for the sealer. Buy a good quality sealer, somewhere between $50 to $100 per gallon. It will hold up much longer than the cheap stuff. Measure you floor and buy more sealer than you need, you can always get a refund on extra bottles. Before you start, tape up any surface you do not want the sealer to contact. Also, make sure your mustard bottle is completely clean! I would wash it a few times so there is absolutely no mustard in the bottle or the spout. The mustard will mix with the grout and create some staining on your tile.

Fill your mustard bottle about 3/4 full with the grout sealer. If it is full, it may come out too fast. You can also adjust the spout to get the desired flow needed to perform the job comfortably. It will take you a few grout lines to get the feel for sealing, just be patient and try not to waste too much of the product. Work an area about 30 to 50 sq. ft. any larger than this and you run the risk of having the sealer dry on the tile to a point where you can’t wipe it off with your wet towel. Paint both the vertical and horizontal lines working backwards, so you don’t come in contact with the sealer you have already put down. Use a smooth, even stroke when applying the grout sealer and try to stay inside the grout lines as best you can. After finishing the first 30 to 50 sq. ft. begin wiping off the excess sealer from the tile.

Using a damp terry cloth, begin wiping up any excess sealer from the tile. Work in a circular motion, going over the area two or three times to make sure there is no sealer left on the tile. Wet and wring out your rag often, so it stays clean throughout the entire sealing process. You can even use new rags every 100 sq. ft. if you wish. Repeat process on the next 30 to 50 sq. ft. until you are completely finished. The sealer will need 3 to 5 days to completely cure, so wet mopping is not recommended.
