Medical Malpractice

Medical malpractice, which is also known as medical negligence, is caused by a physician who gives improper treatment to a health condition, which in turn causes a fresh or worsening health condition. Even though the primary health condition of the patient when he reported for consultation is not the responsibility of the medical practitioner, subsequent problems caused by improper approach in curing the health problem is the sole responsibility of the medical practitioner.

The malpractice may occur due to failure or delay in diagnosing the illness, a mishap, which happened during anesthesia or surgery, or if the practitioner omits to get the concurrence of the patient by providing incomplete details of when a surgery or an operation is to be performed.

Even though a correct diagnosis was made, subsequent improper treatment of the identified illness also constitutes to medical malpractice.

Implants, medical devices or prescription drug misuse also forms part of medical malpractice.

Medical malpractice is bound by the statute of limitations. Even with a valid claim, if a patient waits for a longer period, then the claim will be lost. After the malpractice takes place, a claim should be filed within 2 years. Since medical malpractice involves tricky exceptions and procedures, hence even if two years are elapsed it can still be possible to file a case.

A patient should not try to evaluate the claim by himself or liaise with the doctor or the hospital/clinic to work out a compromise. A decision is made by the insurance company which carried the medical practitioner’s insurance regarding medical malpractice and they have the final and real say in the case.

It is the obligation of the attorney concerned to efficiently and quickly determine whether there is an actionable, good case. Medical malpractice cases are very expensive to go through, they are complex and can be a high risk for recovery and frequently involve the personal attachment of the client.

A detailed medical history dealing with the hospitals and physicians who gave the treatment should be obtained by the attorney prior to the filing of a medical malpractice case. A written summary highlighting all medical treatment received which should include symptoms, conversations with medical professionals and the type of treatment given is required. The attorney will initiate steps to procure all the relevant records from the hospitals or the doctors as a proof of medical negligence.

Normally a medical expert will be appointed by the attorney to determine the extent of medical malpractice. The expert should have been certified in the relevant medical field by the concerned board since he has to appear as a witness to answer questions and give an expert opinion.

With reasonable certainity, the medical expert should conclude that the cause of the damage to the patient is due to the action or inaction of the physician after investigating the procedures thoroughly.

Child and Adolescent Anger: Ways That You Can Help Right Now

What do we do about the violent adolescents?

Good question. Here are some possible answers. Angry children need love. The older and angrier they get, the harder they are to love, and the more frightening they can become. If you have an angry teenager in your home, extended family or community, here are some ideas that may help:

Do everything in your power to get to know them.

Find out what they like to do and do it with them. That’s a stretch in some cases, but do the best you can. They will notice the effort. Stay true to yourself-if they see you trying to become like them, they’ll lose respect for you.

Ask them to tell you about the things they’re interested in. You may have to prove that you’re really interested before they will open up, but if you’re sincere and persistent, they will start talking.

Be a steady, loving presence in their life. You may have to forego some of your other activities, but if you have an adolescent who is possibly moving toward violence or suicide, it’s worth it.

Get in touch with your own healthy anger, so that you have the personal power and confidence to deal with the energy of adolescent anger.

Work to master humor and love. Find as many ways as possible to have fun with the adolescent and show your love. Make sure that you are pursuing the relationship for them, and not to fulfill some unmet needs from your own past.

Consult with other adults and parents who are good with teenagers. Watch how they interact with kids and learn from their example.

Pray. You’re going to need all the help you can get, and you need to know you are not alone in your mission to bring love to this unhappy child.

EMBRACING THE OUTCASTS AND MISFITS

This is simply impossible if you have outcasts and misfits in your own subconscious body/mind. So the first order of business here is to make sure you have found, embraced and made a place for the children within you that you or others may have found that represent remnants of memories that you have yet to resolve. These are the inner children that symbolize your pain, shame and self-doubt.

Rest assured that the outcast child that you approach in the outer world will not accept your embrace if they see unresolved fear and anger in your eyes or actions.

Since we know that the outcasts and misfits are the children most likely to become violent, it only follows that we must pull them into the arms of love and/or acceptance, and find a place where they fit. If our system doesn’t have a place where a child fits, there’s something wrong with the system, not the child.

Look around you in your family and your community. Do you see the outcasts and misfits? The ones that seem to have no friends, or who only hang out with others like them? Look for the ones that don’t act right, are too this or too that or not enough of the other. Especially look for the ones that are not talking about their feelings, and seem to carry a lot of depression and/or anger.

Genius often hides in such places. If you are wise, healthy and dedicated enough to win an inroad to the heart and mind of one of these personas non grata, you may discover a hidden treasure. The movie Good Will Hunting depicts such a case, where an angry, violent misfit is also a gifted genius. The older movie The Breakfast Club also shows us the beauty in the shadow of the misfit.

Kindness and compassion will sometimes be greeted with doubt, fear and even anger at first. If you really mean it, and have the courage to do so, you can penetrate that outer shell and touch the tender heart within. You may be saving someone’s life.

Consider the outcasts and misfits in your world to be unexplored territories of your own soul, undiscovered treasures waiting for you. The rewards will be as great for you as for those you help.

When we look deep enough into any living being, we find the face of God.

Teach this to your children, like Max did in the following example.

Max had come to me for almost four years, to heal from a very painful childhood, and to learn to manage his anger toward his wife. He was making excellent progress, and was tapering off in his sessions.

Max’s son Derek was six years old, and the apple of his dad’s eye. Max was determined to give Derek the healthy guidance, love and positive role modeling he had never received as a child.

Smiling ear to ear, Max told me of some of his recent successes with his wife and son. I have always been afraid I would end up homeless and living under a bridge. So, I decided to confront this fear a little more directly. After church Sunday, Derek and I took about 40 hamburgers to the homeless people living under the overpass downtown. Derek loved it! Now he wants to feed all of the homeless people in the city. Those people were so grateful.

Max was quiet for a moment, as he wiped his eyes and regained his composure. He had given a great gift to some outcasts and misfits, to his son, and to himself.

METHODS FOR HELPING CHILDREN DEAL WITH THEIR ANGER

What to say-When your child is in the middle of expressing anger, your verbal response is extremely important. Though it remains true that your non-verbal signals will speak more loudly than your words, we must not underestimate the power of the spoken word, particularly during intense emotional experiences.

-For a very young child, or if the anger is being expressed mostly in non-verbal ways, say something to the effect of, Wow! I can see that you are really angry right now. I’m sure you have good reasons to be angry. Your anger seems really strong to me. I want you to know that it’s okay with me for you to be angry, and I want to help you deal with it so that nobody gets hurt-including you. In these and other words, communicate the idea that There’s nothing wrong with feeling anger, the important thing is what you do with it.

-Practice reflective listening. Repeat back to the child what you hear her saying in a non-judgmental, soothing tone. This provides a comforting effect, and lets the child know she’s being heard. Start with phrases like, So what I hear you saying is… or So you’re saying… Stick with their words and references, using as little interpretation and as few of your own words as possible.

-Express empathy and understanding. This is simply a matter of imagining yourself in the child’s position, and attempting to see things from his viewpoint. Use phrases like, When I put myself in your shoes, I can see why you would feel that way, or From where you stand, it looks like… or I think I see what you mean or That makes sense to me.

-Avoid teaching, correcting or instructing while your child is angry. Only when the child starts to calm down and relax, you may want to share some of your own similar struggles or experiences. The goal is to help them deal with and understand their anger. Discipline needs to be kept separate from this kind of communication, and administered when both you and the child are calm. That way the child gets the clear message that it is not their emotion that is being disciplined, it is their behavior.

What to do-If your child is small enough, you might want to try holding her during her anger episode. This has been found to be highly effective in many cases. It provides loving, powerful and safe boundaries when the child is feeling out of control. The non-verbal message is, I’m here. I’m not going to leave you. I’m not going to hurt you, and I won’t let you hurt yourself or anyone else. I’m going to hold you until you feel safe again. Here are some recommendations to make this procedure safe and successful:

-If you are extremely afraid or angry yourself, do not try this technique. Your emotions will feed the anger and fear of your child and make the situation worse.

-If you feel comfortable doing so, hold the child from behind, ideally with him sitting in your lap. Protect your face in case he tosses his head back toward you. The goal is for no one to get hurt.

-There needs to be both love and power in your embrace. Strong but not too strong, relaxed but not too relaxed. This lets the child know you are in charge, that you love her and can and will protect her.

-Be ready and willing to devote some time to this. If you don’t complete the process, you may do more harm than good. Hold the child, and wait until he calms down and relaxes. Often he might cry or even fall asleep as the anger subsides.

-Through this gesture you are communicating love, acceptance, safety, protection and power all at the same time.

What to have the child do-In some cases, the child may need to release anger physically. This can be accomplished in a number of ways:

-Supervised play with toys, or play therapy in a professional setting, can be very effective in helping children release anger. The violence that occurs between the toy characters is non-destructive, and can be very informative to the therapist and/or the parent who is observing. This can also include drawing pictures, or throwing clay against a wall or board where no harm can be done.

-Hitting pillows or a mattress with a harmless object such as a nerf bat or bataca bat. This can be done in a playful manner, and the child will still receive benefit. In therapy, I often call it the anger game,, so that children feel safe in approaching the activity.

-Children may sometimes benefit from the temper tantrum technique. Parents should use their own judgment as to when it is necessary to contract for the services of a professional for this type of exercise.

-One of the best parents I know told me that he had his daughters use the Name it, claim it, aim it technique for dealing with anger. In other words he taught them to put a name on their feeling, take responsibility for it, and direct it into some kind of release or constructive activity. An example might go something like, I’m angry and sad, Daddy, (naming and claiming it) and I want you to help me talk to Bobby about taking my things (aiming it). This is an excellent approach, and I highly recommend that parents use this and any other guidelines they run across that help them to teach their children to manage and express their emotions in healthy ways.

In conclusion, I encourage you to do your best to understand everything that is going on in your child’s life and development process. S/he is a complex being, and everything s/he is feeling makes sense at some level. Believe in the goodness of your child. Remember, what you pay attention to grows.

MacGyver (Season 1) DVD Review

A unique and different kind of TV action series, MacGyver made its television premiere in the Fall of 1985 to much fanfare. Audiences immediately responded to the title character and his unusual penchant for turning everyday items like chewing gum and paperclips into elaborate life-saving contraptions. In this way, it maintained a slight resemblance to The A-Team, and this recurring plot device helped MacGyver build a strong cult following…

Richard Dean Anderson plays the title role of MacGyver, an energetic employee of the fictional Phoenix Foundation for Research. An unorthodox hero by action series standards, MacGyver has a deadly fear of heights. A pacifist who refuses to use weapons, he relies heavily on his ability to use his brain and tinker with the various materials at his disposal. MacGyver’s best friend, and the director of the Phoenix Foundation, is Pete Thornton (Dana Elcar). Pete often sends MacGyver on Foundation missions and sometimes comes to his aid (usually after MacGyver has saved the day). In addition, MacGyver is joined on a regular basis by his airplane pilot friend Jack Dalton (Bruce McGill), a man who constantly entangles himself in illegal activities and other troublesome situations. Between the usual slew of bad guys, the vendetta of archenemy Murdoc (Michael Des Barres), and his multitude of troublesome friends, MacGyver is always in the midst of interesting and dangerous events, and the show’s true entertainment value derives from watching MacGyver’s distinctive method of dealing with each one…

The MacGyver DVD features a number of action-packed episodes including the series pilot in which MacGyver is forced to race against the clock when a team of scientists are trapped underground after a lab experiment goes awry. Wanting to contain the leak, the Army allots a small time window for MacGyver to pull off his mission before they destroy the facility… Fans will make note of some interesting aspects of the pilot episode such as Dana Elcar’s role as another character, MacGyver’s use of a gun, and MacGyver’s boss is a man named Gantner (Michael Lerner)… Other notable episodes from Season 1 include Trumbo’s World in which MacGyver, while on expedition in Brazil, encounters and wages war with a mile-wide column of army ants, and Every Time She Smiles in which MacGyver meets up with a beautiful, yet talkative, artist named Penny Parker (Teri Hatcher) and the two must escape the clutches of the KGB…

Indian Bridal Jewelry

For the quintessential Indian bride, the perfect Indian bridal jewelry enhances her looks as much as her make-up does. Her beauty as the blushing bride is amplified not only by the kohl around her eyes and the different hues on her eyelids but also by the eye-catching Indian bridal jewelry that adorns her entire person, from head to toe.

Although much of the Indian bridal jewelry an Indian bride could wear is dependent on the size of her budget, she usually sees to it that she is bedecked with the most lavish ones that she could lay her hands on. This is actually part of her presenting herself not only to her husband but also to the public. Because of this, an Indian bride would want her Indian bridal jewelry custom-designed.

An Indian bride would have her Indian bridal jewelry made, based on her wedding trousseau, especially on its dominant colors. The type of precious metals and stones that will be used in making the jewelry should blend with the colors of her wardrobe.

Indian bridal jewelry is not just one piece of jewelry worn by the Indian bride. It is made up of different pieces that complements and blends with each other to create that perfect look of an Indian bride. The Maangtika, the nose ring, the earrings, the bangles, the necklace, the anklets and toe rings make up the entirety of the complete Indian bridal jewelry.

The Maangtika is the most traditional and most essential part of the Indian bridal jewelry. Apart from the necklace, the Maangtika is the most noticeable piece of the Indian bridal jewelry adorned on an Indian bride. It is worn on the bride’ head and is designed to be unique for each bride. While its color and design largely depend on the colors of the bride’s outfit, it is usually made of precious stones like pearls and diamonds. It has a centerpiece that is exquisitely designed and sits on bride’s forehead and is usually attached by a string that runs to the back of the bride’s head.

Another essential part of the Indian bridal jewelry is the necklace. This piece is usually very eye-catching with a design that is in tune with the other pieces of Indian bridal jewelry adorned on the rest of the bride’s body. The design of the necklace would also have to complement the neckline of the bride’s wedding attire. Most of the common types of necklaces worn as part of the Indian bridal jewelry are the chokers and the long necklaces with elaborate designs and bedecked with precious stones that goes with the bridal colors. Chokers are worn over dresses with high necklines while the long necklaces complement those wedding dresses that have deep necklines.

An Indian bridal jewelry ensemble will not be complete without the traditional nose ring. This is as much a part of the Indian bridal jewelry as the Maangtika and is usually almost of the same design and color as the earrings. The traditional nose ring is called the “nath” and is made up of a ring worn at the nose that is studded with precious gems and has a long chain whether in gold or silver, that is attached to the hair of the bride. The rest of the pieces that go with the entire Indian bridal jewelry are as just as important. They are all needed to complete the look of the perfect Indian bride.

There are many wonderful poker books that can teach you everything about poker, even how to play as a professional.

If you have never played before and you want to take a few basic lessons then it would best for you if you purchase poker books for beginners. They will teach you the basics - the rules, the etiquette and the card variations. Once you get started, the game will enchant you and you would want to learn everything about the different card combinations and the best way to play them. Of course, poker as many other card games is a game of chance. However, there are many things you can do after the cards are dealt, so that you will have better chances at winning. Whether you will pass on or go all in depends on your cards and if you want to take the right decision, you should read some poker books.

There are also many poker books for advanced players who wish to learn the more difficult and tricky moves and techniques. Many of the books we are talking about are written by famous professional poker players. If you get a book from a pro and you learn it, then no matter on what table you sit in, you will not look like an amateur. Putting Together the Perfect Halloween Costume

If you’re going to a costume party or some other event for Halloween, you probably want to really impress everyone with your costume. And the best type of costume is one that will really let you get into character - something that you feel proud to be wearing.

You can put together your own costume or buy one of the cheap ones that you’ll find at your local drug store, but to really go the distance and get a great costume it pays to get it through a professional costume store. Whether you rent it or buy it, you’ll be a lot happier with the results.

A good costume store won’t try to sell you more than you need. They’ll help you to find a costume that suits both your needs and your budget. They’ll also make sure you’re familiar with how to don the costume, and any other accessories or makeup that goes along with it.

To really make a splash at the costume party, you want to go all the way with your costume. Don’t cut corners and try to save a few dollars by going with something cheaper or not as complete.

Get all the accessories you’ll need - makeup, props, a quality mask, etc. Having the complete package will make your costume that much more realistic (and will make it that much harder for your friends to recognize who you really are!)

If you’re not sure exactly what accessories you’ll need, do a little research. Are you thinking of going as an elf from The Lord of the Rings? Watch the movies again to pick up all the details in the costumes.

Or perhaps you want to be a pirate this year? The Pirates of the Caribbean movies can give you a ton of good ideas for your costume.

Take the time to get all the details just right and you’ll be the talk of the party - even if nobody knows who you really are!

Monty Smith writes about Halloween costumes and other Halloween-related topics for the Best Costumez website. Get more Halloween tips at www.bestcostumez.com http://www.bestcostumez.com .

How to Finally Quit Smoking

More than four hundred and forty thousand people die in the United States each year from smoking. Smoking is directly responsible for causing lung cancer, heart disease, strokes, and pregnancy complications, not to mention contributing to overall poorer health. So why do so many people still smoke? Because trying to quit is one of the most difficult things to do. However, you CAN do it with a little help and determination.

If you smoke and have tried to quit, you know how difficult and painful it can be. Many people actually try a number of times before they are successful. What makes it so difficult is the fact that nicotine is an incredibly addictive drug, on the same level as cocaine or heroin.

Switching to low-tar and/or low-nicotine cigarettes is a tactic that many people try, thinking that it will be less harmful. However, because nicotine is so addicting, switching will only make you puff harder and more often on each cigarette. Your only choice for your body’s health is to quit completely.

In spite of the many risks associated with smoking, some smokers, particularly women, believe there are also risks associated with quitting. These perceived risks, gaining weight, increased stress, and damaging relationships with friends who do smoke, can reduce a smoker’s motivation to quit resulting in a lower chance of success.

What can help motivate a smoker to quit? Quitting smoking is one of the most important things you will ever do. Consider the following:

REASONS FOR QUITTING

*First and foremost, you will live longer and you will live a healthier life.

*Your risk for developing heart disease, cancer, lung disease, stroke and other health conditions will diminish significantly.

*You will be amazed at how much better you will feel and how much better you will be able to taste and smell.

*You will save money. (The price of cigarettes today means you will save a lot of money!)

WHAT TO DO WHEN YOU ARE READY

When you are ready to quit, follow the steps below. They will increase your chances of success and help you kick the habit for good.

*Set a quit date and stick to it. Period.

*Change your environment. You MUST do this to succeed.

1. Get rid of every ashtray you have, in your home, your car, your office, everywhere.

2. Do not allow anyone to smoke in your home, ever.

3. If you associate any particular item or event with smoking, such as having a cup of coffee, eliminate those things for a period of at least a couple of months.

*Change your behaviors.

1. When you have the urge to smoke, participate in activities that will distract you like going for a long, leisurely walk with a friend or family member, clean house, play with your kids, call a support person to talk you through the tough time.

2. Change your routine. Drink hot tea instead of coffee, instead of eating in front of the TV, eat at the kitchen table with your family.

3. Try some soothing stress reducers like taking a long hot bath, starting an exercise regimen, or reading a good book.

4. Plan something different or enjoyable every day, whether it is a solitary activity or something to do with family or friends.

*If you have made previous attempts to quit and failed, analyze those attempts and try to deduce why they did not work.

*You will have a better chance of success, if you enlist the support of others.

1. Tell everyone you know, your family, friends, and co-workers that you are going to quit and ask for their support.

2. Ask them not to smoke around you and not to leave cigarettes laying around.

3. Find out what kind of support programs your local hospital or health care center offer.

4. There are medications that can double your chances of success. Ask your doctor for advice.

*Drink lots of water to help flush the toxins out of your body. Drinking a lot of water will also help fill you up so you will not be so inclined to overeat.

*Once you quit, DO NOT TAKE ANOTHER PUFF, EVER! Keep yourself away from as much temptation as possible.

BE PREPARED FOR DIFFICULTIES

Many people have relapses within the first couple of months after quitting and many people try to quit several times before they are successful at it. Do not be discouraged and give up if this happens. Set a new date and start over but DO NOT GIVE UP! Below are situations that may challenge you:

*DO NOT BE AROUND OTHER SMOKERS unless you have to. Being around other people who are smoking when you are trying to quit can be an agonizing experience.

*DO NOT GET DEPRESSED. There are many ways to uplift your spirits. Count your blessings, congratulate yourself for quitting, and find something to do that you enjoy.

*AVOID DRINKING ALCOHOL. It can lower your chance of success.

*DO NOT WORRY ABOUT WEIGHT GAIN. The most common concern for many people who are considering giving up smoking is weight gain. Do not ever use this as an excuse.

While most people usually gain around 10 pounds after they quit smoking, there is no reason you have to. Follow a healthy eating plan and get 20 minutes of physical activity every day.

Follow the tips above. You CAN quit smoking!

English Will Always Be The Language Of The U.S.

Our citizens who think English will disappear in our own country are worrying over nothing. People who want to pass laws making it our official language are wasting time and effort. I read recently that someone called the United States a language graveyard . People from all countries with more than 300 languages come here and in a couple generations have lost all languages except English.

English will always be the main language in this country, regardless of how many people complain about having to choose English or Spanish on the telephone or how many signs they see in Spanish or other languages. The most common argument to this statement is that there are so many Latinos here now who don’t speak English that they will simply outnumber English speakers and English will be lost. This may make sense to these worriers, but there is no study that backs it up. Latinos are losing their language at exactly the same pace as all immigrants before them lost theirs.

All studies prove that by the second generation, immigrants are fluent in English while using their native language at home. By the third generation, they have almost all lost their native language and only speak English. This means that grandchildren usually are not able to have a conversation with their grandparents.

This is what has always happened in this country. Germans, Polish, Italians, Asians - all did the same thing. The first generation struggled and learned a little bit of English, their children spoke both languages and their grandchildren spoke only English.

Of the more than 300 languages spoken in this country, English is the language that unites us. It is the language needed to get ahead. It is the language needed to get a good education, to get a good job, to live up to our full potential. Many of these 300 languages will be extinct in 100 years, English won’t be.

About 15 years ago, I was sitting in a hotel restaurant in Taipei, Taiwan, eating breakfast. There were three businessmen sitting at the next table going over a contract to purchase and ship greenhouse cactus plants. One man was German, one was Taiwanese and the other was Italian. They were using English as their common language.

None of them spoke English very well and all had heavy accents. They were having a very hard time understanding each other through these individual accents. I could understand all of them quite well. I offered to help them, but they politely refused my help.

English is used all over the world, often, as with these men, as the only common language. School children everywhere learn English. They may not be fluent in it, but they are familiar with it and can function in it if necessary.

The reason there are language choices on telephone messages and signs in Spanish at banks and offices is because businesses have decided to serve these immigrants in their own language. It helps their business serve a group of people with enormous purchasing power. It is simply a business decision.

In some ways it is doing Latino immigrants a disservice, because it makes it almost unnecessary for them to learn English. They can get by in most situations in Spanish. But they will not be able to help their children get a good education, they won’t be able to get better jobs, they will have great difficulty if they ever have an emergency and need medical or police assistance. They will always be held back by the language barrier.

Instead of complaining about people not learning English fast enough, I think my fellow citizens should try to help immigrants learn English. Instead of being upset that they are taking longer in line at the store, we can offer to help them understand the question or make change. In the lunch room at work, we can trade words and phrases in our language with coworkers in their language and we will all learn. Some people seem to think that in order to teach, we have to be trained teachers, but we can teach and learn every day.

Most ESL classes in the country have long waiting lists of people wanting to learn English. Many times the classes are at inconvenient times or places for the students. Many immigrants work two jobs and long hours and are unable to attend classes. They will appreciate and benefit from any help we can give them individually.

It is incredibly hard to learn a new language as an adult. Adult brains are not as pliable and willing to think in another language as the brains of children are. It takes slow, patient repeating of words and constant practice. It requires a lot of nerve to take a chance, speak up and possibly be wrong, misunderstood or ridiculed. It requires a partner to practice with who doesn’t laugh at mistakes.

English has never been seriously threatened as the dominant language of the United States, the languages that immigrants bring with them to the U.S. are endangered. It is not necessary to try to make English the official language. It won’t make any difference.
